Overview

Privilege is a complex issue. It is important to identify and know how to deal with issues of privilege when they arise, which is frequently.  You must know when privilege will attach to communications and information. You must also understand how privilege applies prior to (and in the course of) litigation, and in the context of settlement offers and employee terminations. Issues of privilege are also significant in the context of internal investigations and in the hiring of experts and consultants.

Format

In this CPD accredited session, we will discuss the numerous issues surrounding Privilege including:

  • Solicitor-client privilege
  • Litigation privilege
  • Confidentiality privilege
  • Investigations and privilege
  • Common-interest privilege
  • Recent case law developments

The session will also include a structured Q&A panel discussion. Our presenters will invite questions and remain behind for any informal discussions you may wish to have.

Learning Objective

By the end of this seminar, attendees will have a better understanding of all things privilege. Attendees will gain an understanding of when issues of privilege arise, and the necessary steps needed to ensure that privileged communications and information are protected.
