Catherine Peters Publishes Article on Religious Leave in Education Today

Catherine Peters of Hicks Morley’s Toronto office recently published an article in the Spring 2009 edition of Ontario Public School Boards’ Association’s publication Education Today. The article, “Accommodation of Religious Holidays: What Are School Boards’ Obligations?“, summarizes two recent decisions of interest to school boards dealing with accommodation of religious leave. The first decision, York Region District School Board, dealt with the nature of the proof of entitlement to religious leave a school board can require. The second decision, Markovic v. Autocom, held that, contrary to an Ontario Human Rights Commission policy statement, there is no blanket requirement to provide two days of paid religious leave to mirror the statutory holidays on Christmas and Good Friday.
