“The employer is obligated to ensure the safety and health of the workplace. The employer is also required to provide reasonable accommodation when they know or ought to have known such accommodation is required for an employee to complete the essential duties of their occupation […] Therefore health and safety considerations in the case of medical marijuana constitute an undue hard- ship upon the employer” Kees said.
