An article by Hicks Morley’s Scott Thompson appeared in the April 2011 issue of Canadian Safety Reporter. In the article, “Employers must consider independent contractors in determining need for JHSC“, Scott reviews the case of R. v. United Independent Operators Limited 2011 ONCA 33 (CanLII), where the Ontario Court of Appeal concludes that independent truck drivers are “regularly employed” under the Occupational Health & Safety Act for the purposes of determining that a joint health & safety committee is required at a workplace at which twenty or more workers are regularly employed.
