Stephanie Kalinowski Quoted in Benefits Canada on LTD Coverage Cases

Benefits Canada quoted Hicks Morley’s Stephen Gleave and Stephanie Kalinowski  in an October 12, 2018 article titled “Legal Cases Highlight Issues Around LTD Coverage.” In particular, the article discusses the decision of the Human Rights Tribunal of Ontario in Talos v. Grand Erie District School Board, which raises issues about the provision of benefits to employees aged 65 and older.

“The full impact of the decision is limited and has yet to be determined,” Stephen Gleave said. “The decision only applies to the parties involved on the facts of the particular case, […] and the adjudicator has yet to decide whether any remedy is appropriate or necessary,” he added.

With more workers staying in the workforce past age 65, some employers have already been considering these issues. Stephanie Kalinowski explains that “Quite apart from the Talos decision, some employers have been thinking of what an aging workforce means for them and their benefits programs.” She also added that “Among the considerations is how they want to position themselves as employers, what their competitors are doing and the impact on their overall compensation costs.”
