Rachel Arbour Discusses Workforce Restructuring with Canadian Lawyer InHouse Magazine

Rachel Arbour of Hicks Morley’s Toronto office was recently quoted in Canadian Lawyer InHouse Magazine for an article entitled “Workforce Restructuring: Legal pitfalls abound when controlling costs through a restructured workforce.” The article discusses the alternative ways employers are cutting costs during the current economic downturn and the associated legal risks. Rachel cautions that the legal risks of changing employment terms have not changed as a result of the economic downturn. She also says that employers can limit their legal risks by providing advance notice and relying on the mitigation-of-loss obligations of employees. It’s important to find the balance between the company’s welfare and what concessions are reasonable to ask of employees.
