A recent decision out of Alberta reminds employers that off-duty conduct, including conduct on social media, can be grounds for workplace discipline. The decision underscores an employer’s right to investigate and discipline employees for social media conduct if that conduct creates a hostile or toxic work environment. “It could give rise to investigations in the workplace, and it could give rise to discipline in the workplace, including a suspension, warning letter, and even termination,” Ryan explained.
