Overview
Disability accommodation and racial discrimination are not well-suited to cookie cutter solutions. To help guide you through these consequential workplace challenges, this workshop will provide a legal update on racial discrimination, the accommodation process, systemic discrimination, and medical documentation management. We will also examine how adjudicators at the Ontario Human Rights Tribunal, labour arbitration, and civil proceedings contemplate such matters, considering the interplay of legal obligations, general principles, and key factual issues. This workshop will provide practical tools for preventing and properly responding to racial discrimination in the workplace and attend to a variety of accommodation requests.
Format
In this hands-on, interactive workshop, we will address:
- the different forms that racism may take in the workplace
- the general principles of disability management
- the appropriate responses to and investigation of racial discrimination complaints
- the concept of frustration and how to reconcile this with the duty to accommodate
- the common misconceptions regarding the nature and prevalence of racism in the workplace
- independent medical examinations—when they are appropriate and when they can be made compulsory
- key considerations for the effective implementation of anti-discrimination policies and procedures
- how to effectively communicate with employees seeking accommodations
Audience and Learning Objectives
This workshop is designed to provide frontline HR professionals and legal counsel with the tools needed to address disability accommodation and racial discrimination in the workplace.
By the end of the program, attendees will be able to:
- identify and respond to instances of racial discrimination
- better manage disability and accommodation issues in the workplace
- effectively address legal problems in a manner that promotes the goal of a truly inclusive workplace while mitigating legal risk
