Overview

Mediation is becoming an ever-present fixture in all forms of employment litigation, whether that be in civil litigation or in matters before boards and tribunals. Mediation is a critical stage in the litigation process. It is important to take a holistic approach to the mediation process, one that does not focus on just the mediation itself. Careful consideration should be given to the timing of the mediation, the identity of the mediator and your approach to settlement authority in order to ensure that the mediation serves your strategic goals. You must also think carefully about your broader approach to the mediation itself to ensure a “successful” mediation, whether or not a mediation results in a mediated settlement.

Format

In this Advantage CPD webinar, we will discuss many issues surrounding mediations, including:

  • when to mediate
  • how to choose a mediator
  • how to mediate effectively
  • common mediation pitfalls
  • mediation in the world of Zoom
  • post-mediation issues

Learning Objectives

By the end of this seminar, attendees will know how to effectively mediate and understand the necessary steps needed to ensure that a mediation is a success.

The session will also include a structured Q&A panel discussion. Our presenters will invite questions and remain behind for any informal discussions you may wish to have.
