Overview

At the Human Rights Tribunal of Ontario (HRTO), employers and service providers must be strategic with respect to the HRTO’s specific procedural practices and tendencies, in addition to matters involving legislation and case law. The way employers and service providers respond to HRTO applications, preserve evidence, and prepare for hearings must be informed by the current status of the HRTO.

Format

This session will provide insights regarding how to best navigate HRTO proceedings, including:

  • managing applications before the “new” HRTO (navigating the changing HRTO landscape)
  • how clients can be prejudiced by the inordinate delays in getting hearings adjudicated and by the unorthodox ways in which hearings now proceed
  • beginning-to-end approach to dealing with these issues so that if and when a Blencoe-type argument is made, the client will have the necessary information and evidence gathered from the outset of the application to effectively advance that argument
  • case law update

This webinar will include an interactive Q&A feature. A panel discussion will be built into the last 10 minutes of the session to address audience questions that were submitted.
