Human Resources Legislative Update

Redeployment Ability of Health Service Providers (Including Hospitals) Expanded

Date: January 18, 2021

On January 18, 2021, the Ontario government amended Ontario Regulation 74/20, Work Redeployment For Certain Health Service Providers (Regulation), made under the Reopening Ontario (A Flexible Response to COVID-19) Act, 2020.

The amendments – which came into effect January 18, 2021 – are intended to help alleviate the increasing staffing and capacity issues faced by hospitals in the second wave of COVID-19.

As a result of these amendments, health service providers are now permitted to redeploy staff to retirement homes and other health service providers, including hospitals, in addition to long-term care homes. The Regulation states that staff of a health service provider who are deployed to another health service provider still remain staff of the deploying health service provider.
