Extended Day and Third Party Program Regulation Filed Under the Education Act

On May 9, 2016, the Ontario government filed O. Reg. 129/16 made under the Education Act. O. Reg. 129/16 amends O. Reg. 221/11 (Extended Day and Third Party Programs) and is the supporting regulation to amendments made to the Education Act by the Child Care Modernization Act, 2014. Those amendments set out requirements for a board operating an extended day program or ensuring that a third party program is operated by a person or entity other than a board for pupils enrolled in junior kindergarten, kindergarten or grades 1 through 6. Among other things. O. Reg. 129/16:
- requires boards to operate an extended day program or ensure the operation of a third party program for pupils in grades 1 to 6 in applicable elementary schools, commencing in the 2017-2018 school year
- sets out certain exceptions to the foregoing requirement
- establishes a planning process for boards to undertake by the end of April of each school year for the next school year regarding the provision of these programs and to determine, among other things, the schools in which the program will operate and certain program details
- requires boards to determine the daily fee and, where applicable, the non-instructional day fee and to post that information on the board’s website and provide it to parents of enrolled pupils
