WSIB to Add New Classification Applicable to Temporary Employment Agencies

A recent amendment to the Workplace Safety and Insurance Act, 1997 regulations has resulted in the creation of a new Workplace Safety and Insurance Board (WSIB) classification which will allow temporary employment agencies (TEAs) to report the supply of administrative, clerical and knowledge-based labour under one classification for premium-setting purposes. This new classification will take effect January 1, 2025.

Currently, TEAs must report and pay premiums for labour provided to their clients under the client’s premium classification. As of January 1, 2025, TEAs will use the new classification 001281 Supply of administrative, clerical, and knowledge-based labour for TEA workers who are supplied to provide:

  • administrative and support services
  • data analytics
  • document preparation services
  • human resources
  • information services
  • information technology services
  • research services
  • software development
  • generally, financial services, scientific, professional and management duties otherwise included in Class K or Class L

The new classification will be added to Class L. Currently, Class L has a class premium rate of $0.20 per $100 of insurable earnings.

This new classification reflects that administrative, clerical and knowledge-based workers engage in work which carries a low risk of injury. Where a TEA provides workers who supply labour that does not fall within this new classification, the TEA will continue to pay premiums based on the client’s premium classification.

While this new classification does not come into effect until January 1, 2025, the WSIB has also published an advance copy of its operational policy for this new classification code to provide guidance to TEAs on its implementation.
