WSIA Calculation for Premium Payable by Employers for 2021 Amended

On April 14, 2021, Bill 238, Workplace Safety and Insurance Amendment Act, 2021, received Royal Assent and came into force.
Bill 238 amends the Workplace Safety and Insurance Act, 1997 (WSIA) to add a calculation rate for the 2021 calendar year (or such later date as prescribed by regulation) for the Workplace Safety and Insurance Board (WSIB) premium payable by employers. The maximum amount of earnings, per worker, subject to WSIB premium for 2021 will be $97,308 or such other amount as may be set out by regulation. The previously communicated amount was $102,800. A regulation made under this amendment cannot specify a date later than December 31, 2022.
The Ontario government states that this change will protect employers from an unexpected increase in the WSIB premiums during this period.
Bill 128 also adds a provision that the Minister (or their delegate) may direct the WSIB to provide the Minister with information that the Minister considers necessary for the proper administration of the WSIA.
