Overview

Incentive plans have been the subject of recent scrutiny by the courts, at times resulting in unfavourable decisions for employers and high payouts to employees. The specific wording of an incentive plan and how the plan was rolled out to employees play key roles in these decisions. From drafting, to rollout, to defending claims in litigation, understanding the life cycle of an incentive plan is critical to achieving your intended outcome.

Format

In this Advantage CPD webinar, we will review key principles from related case law, common pitfalls to avoid and best practices in the following areas:

  • incentive plan termination clause wording
  • the defence of employee claims, including competitive concerns
  • settlement strategies
  • how to amend incentive plans
  • communication and rollout of incentive plans.

Audience and Learning Objectives

This session is designed for professionals in human resources and total compensation and rewards who have responsibility for incentive plans, including annual cash bonus plans, equity and long-term incentive plans, and commission or sales bonus plans. Attendees will learn about wording that has been previously reviewed by courts and will gain insight into how to defend against employee claims for expanded entitlements under incentive plans following termination. Attendees will also learn strategies for making plans less vulnerable to a successful challenge in the future.

This webinar will include an interactive Q&A feature. A panel discussion will be built into the last 10 minutes of the session to address audience questions that were submitted.
