When litigation is anticipated, a key issue that is often innocently overlooked is the immediate need to preserve all evidence in your possession that may become relevant through the proceedings. Failing to do so may have adverse consequences to your organization.

At this Advantage session, we will take you through the legal principles and provide an in-depth analysis of your obligations as counsel under the Rules of Professional Conduct.

This will include:

  • An overview of the law of preservation of evidence, what it means on the “ground” and its practical implications for your organization
  • What in-house counsel needs to know about “litigation holds” and how to make them effective
  • Practical tips on how to recover information that may have been “accidentally” deleted
  • Your professional obligations when your client tells you the laptop was “stolen”, the BlackBerry was lost in the jungle and eaten by a gorilla, and so on – 30 minutes of hands-on professionalism through use of hypotheticals.
