A recent decision out of Québec reminds employers that they must tread carefully when addressing union-related concerns raised by employees. The decision underscores the importance of understanding the legal boundaries of employer communication during union drives. “[Legislation] says that employers must not use coercion, intimidation, threats, promises, or undue influence and must not participate in or interfere with the formation, selection, or administration of the trade union. But it also provides that the employer is able to express its views and communicate,” Michael explained.
