New and Evolving Issues in Disability Accommodation

The accommodation of disabilities is one of the most challenging aspects facing human resources professionals and in-house counsel for both employers and service providers. Ever-evolving jurisprudence, along with recent developments in legislation, have also imposed additional challenges, new obligations and in some cases require thinking “outside the box” as employers and service providers alike are faced with new and increasingly complex requests for accommodation.

Successfully defended a pension plan administrator in a series of applications before the Human Rights Tribunal of Ontario where the applicants claimed that the pension plan’s re-employment provisions discriminated against pensioners on the basis of age.
