Overview
As institutions migrate their data almost exclusively to electronically stored formats, unique freedom of information (FOI) access issues arise when confronting requests for such records. These include dealing with data on personal devices or on the servers of messaging apps, addressing records stored on archaic media formats and conducting effective filtered searches to avoid the risk of challenges as well as the circumstances in which an institution can successfully claim that electronic data does not constitute a “record” for the purposes of the Freedom of Information and Protection of Privacy Act (FIPPA) or the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA).
