Retirement issues are in the spotlight like never before as everyone from governments to employers grapple with rising costs for pension and healthcare, while pension plan members and retirees may prefer to preserve the status quo. This session will highlight key developments in these changing times.

  • What’s New? – A review of key case law and regulatory developments over the last year
  • DB Redesign – Recent cases and issues to consider when making design changes to defined benefit pension plans. Moving beyond specific benefit features such as early retirement subsidies and indexing, this topic will also look at other options for change such as joint governance and target benefit/shared risk models
  • Retiree Rights – Examining the recent GM case and others which may change how employers approach changes to retiree benefits
  • DC Plans Today – 10 years after the CAP Guidelines were released, we will focus on the trend toward using Target Date Funds as a plan’s default investment option and canvass recent related U.S. litigation, and on challenges with member communication and engagement
  • Preserving Your Rights – The pension plan Administrator as Defendant and Plaintiff: practice management tips for in-house counsel related to records retention and tracking limitation periods and their role in the ability to defend against claims and to recover overpayments
