Ontario Seeking Input on Occupations Exempted Under ESA

As part of Ontario’s review of workplace laws, the government has announced that it is reviewing the special rules and exemptions under the Employment Standards Act, 2000 (ESA). It is seeking public input on the following occupations currently exempted:
- Architects
- Domestic Workers, Homemakers and Residential Care Workers
- IT Professionals
- Managerial and Supervisory Employees
- Pharmacists
- Residential Building Superintendents, Janitors and Caretakers
The exclusion of domestic workers under the Labour Relations Act, 1995 (LRA) is also being reviewed.
This public consultation is part of the government’s general review of the ESA and the LRA in response to the final report of the Changing Workplaces Review (Final Report). Those wishing to participate in the consultation process should email exemptions.review@ontario.ca and request the exemption toolkit relating to the specific occupation you wish to comment on. Written submissions are due by December 1, 2017.
