Overview

For non-legal professionals, dealing with the legal aspects of employee and labour issues can be complex. This session will break down the legalese and arm you with best practices and strategies to effectively settle grievances—and, when a settlement can’t be reached, how to prepare a grievance for arbitration.

Format

Topics include:

  • making inquiries: learn what questions to ask and what steps to take to gather the relevant evidence and assess the merits of the case
  • identifying preliminary objections during the grievance procedure
  • making deals: how to leverage a grievance meeting or mediation to resolve a grievance and terms to include in a Minutes of Settlement
  • how to effectively work with external counsel to prepare for arbitration when a grievance can’t be resolved in the grievance procedure
  • production: assessing what is relevant and understanding what can be excluded due to privilege and dealing with privacy issues
